The draft of a bill for an independent tribunal was first sub- mitted to the House Committee by Mr McCrary, January 10, 1877. Mr McCrary was a lawyer of unusual ability, and as a constructive statesman he ranked very high. As soon as the plan came under discussion it became apparent that Chief Justice Waite would not be acceptable to the Democrats. It was alleged that during the canvass he had spoken of Mr Tilden in terms of personal hostility, his language befitting a partisan, rather than a judge.
